Terms of service
OVERVIEW
Welcome to Marissa Lazaridis. The terms “we,” “us,” and “our” refer to Marissa Lazaridis. Marissa Lazaridis operates this store and website, including all related information, content, features, tools, products, and services offered through the website (the “Services”). This store is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service, together with any policies referenced herein, describe your rights and responsibilities when you access or use the Services.
By visiting, interacting with, or using the Services, including purchasing artwork or other products, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms, you should not use or access the Services.
SECTION 1 – ACCESS AND ACCOUNT
By using the Services, you represent that you are at least the age of majority in your state, province, or jurisdiction of residence.
To use certain Services or make a purchase, you may be asked to provide information including your email address, billing information, payment information, and shipping information. You represent that the information you provide is accurate, current, and complete.
You are responsible for maintaining the security of your account credentials and for activity conducted through your account.
SECTION 2 – PRODUCTS AND ARTWORK
We make every effort to accurately represent artwork, prints, materials, dimensions, and other products offered through the store.
However, colors and appearance may vary depending on your screen, device, display settings, lighting, and the nature of reproducing an original artwork digitally.
Product descriptions, availability, pricing, dimensions, materials, edition information, and other details are subject to change when appropriate. We reserve the right to discontinue products or limit quantities at our discretion.
SECTION 3 – OWNERSHIP OF ORIGINAL ARTWORK
When you purchase an original artwork, you acquire ownership of the physical artwork only.
Unless otherwise agreed to in writing, all copyright, reproduction, licensing, image, and other intellectual-property rights remain with Marissa Lazaridis.
Purchase of an original artwork does not grant permission to reproduce, print, license, distribute, commercially exploit, or create derivative works from the artwork.
We retain the right to reproduce and display images of sold artwork, including for portfolios, publications, exhibitions, websites, social media, archival purposes, and promotional materials.
If an exhibition, museum, gallery, publication, or similar opportunity involving a sold artwork arises, the owner may be contacted regarding the possibility of temporarily lending the work. Any such loan remains at the owner's discretion.
SECTION 4 – FINE ART PRINTS AND REPRODUCTIONS
Fine art prints are reproductions of original artwork by Marissa Lazaridis.
Purchase of a print grants ownership of the physical print only. All underlying copyright, reproduction, licensing, and image rights remain with Marissa Lazaridis.
Prints may not be reproduced, copied, scanned for reproduction, commercially distributed, used for branding or promotional purposes, or otherwise commercially exploited without prior written permission.
Fine art prints may be produced and fulfilled by professional third-party fine art printing and fulfillment partners.
SECTION 5 – COMMISSIONS
Custom artwork requires a 50% non-refundable deposit before work begins unless otherwise agreed in writing.
A preliminary sketch will be provided for review. The client may provide feedback or request revisions during the sketch phase. Once the sketch has been approved and painting has begun, further compositional revisions may not be accommodated.
A final photograph of the completed artwork may be provided prior to shipment.
The remaining 50% balance must be paid before the completed artwork is released or shipped.
Estimated commission timelines are approximately 6–10 weeks unless otherwise stated. Timelines are estimates and may vary depending on the size and complexity of the work, materials, workload, or circumstances outside our reasonable control.
If a client cancels after approving the sketch, the initial deposit will be retained. If the commissioned artwork has already been completed, any remaining balance may still be due in accordance with the commission agreement.
Unless otherwise agreed in writing, commissioning an artwork does not transfer copyright or reproduction rights to the client.
SECTION 6 – BACKSTAGE PRINT CLUB
The Backstage Print Club is a recurring subscription offering that may include a monthly art print, letter, or other materials as described on the applicable product page.
By purchasing a Print Club subscription, you authorize recurring charges according to the billing frequency and price disclosed at the time you subscribe.
Your subscription will continue until canceled in accordance with the cancellation options provided through the store.
Changes to pricing or the contents of future Print Club offerings may occur from time to time. Any changes affecting an existing recurring subscription will be handled in accordance with applicable law and the terms presented to the subscriber.
Monthly mailing schedules, cutoff dates, and other fulfillment information may be provided on the Print Club product page.
Print Club shipments may be mailed separately from other purchases and may not include tracking. International delivery times can vary depending on destination and postal services.
SECTION 7 – ORDERS
When you place an order, you are making an offer to purchase.
We reserve the right to accept, decline, modify, or cancel an order where reasonably necessary, including in cases involving product availability, pricing or listing errors, suspected fraud, or other issues affecting fulfillment.
Payment must be successfully processed before an order can be fulfilled.
Please carefully review your order, including product, size, quantity, and shipping information, before submitting it.
Purchases are subject to our Refund Policy.
SECTION 8 – PRICES AND BILLING
Prices, products, discounts, and promotions may change without notice.
The price charged will be the price displayed at the time the order is placed, subject to correction of obvious errors.
Unless expressly stated otherwise, listed prices may not include applicable taxes, shipping, customs duties, import charges, or other fees.
You agree to provide accurate and current billing and payment information.
SECTION 9 – SHIPPING AND DELIVERY
Shipping, processing, production, and delivery estimates vary depending on the product, destination, and fulfillment method.
Delivery dates are estimates and are not guaranteed. Delays may occur due to carriers, customs, weather, production, or circumstances outside our reasonable control.
Complete information regarding production, shipping, international delivery, originals, commissions, and the Backstage Print Club is provided in our Shipping Policy.
SECTION 10 – RETURNS, EXCHANGES AND DAMAGED ORDERS
All sales are final. We do not accept returns or exchanges except where required by applicable law.
If an order arrives damaged, defective, or incorrect, please contact us as described in our Refund Policy so that the issue can be reviewed and resolved.
Our complete return and refund terms are provided in our Refund Policy.
SECTION 11 – INTELLECTUAL PROPERTY
All artwork, paintings, drawings, photographs, prints, written material, letters, graphics, images, videos, designs, branding, website content, and other creative materials displayed through the Services are owned by Marissa Lazaridis or used with appropriate permission and are protected by applicable intellectual-property laws.
Except as expressly permitted, you may not reproduce, distribute, modify, publish, commercially exploit, download for reproduction, create derivative works from, or otherwise use our intellectual property without prior written consent.
Nothing in these Terms grants you a license or ownership interest in our intellectual property merely because you purchased a physical artwork or product.
All rights not expressly granted are reserved.
SECTION 12 – OPTIONAL TOOLS AND THIRD-PARTY SERVICES
Certain features or Services may be provided through third parties, including Shopify, payment providers, printing and fulfillment partners, shipping carriers, and other service providers.
We do not control every aspect of third-party services and cannot guarantee their uninterrupted availability.
Your use of third-party services may also be subject to the applicable third party's own terms and policies.
SECTION 13 – THIRD-PARTY LINKS
The Services may contain links to third-party websites or services.
We are not responsible for the content, accuracy, availability, policies, or practices of third-party websites. If you leave our website to access a third-party service, you do so subject to that third party's terms and policies.
SECTION 14 – RELATIONSHIP WITH SHOPIFY
Marissa Lazaridis is powered by Shopify, which enables us to provide the Services to you.
However, purchases made through this store are transactions directly between you and Marissa Lazaridis. Shopify is not the seller of the artwork or products offered through this store.
SECTION 15 – PRIVACY
Personal information collected through the Services is handled in accordance with our Privacy Policy.
Because the Services are hosted by Shopify, certain information may also be collected and processed by Shopify and other service providers necessary to operate the store.
Email addresses submitted for marketing or newsletter communications will be handled according to the consent provided and our Privacy Policy.
SECTION 16 – ERRORS, INACCURACIES AND OMISSIONS
Occasionally, information on the website may contain typographical errors, inaccuracies, or omissions relating to product descriptions, dimensions, pricing, availability, shipping charges, delivery estimates, or other information.
We reserve the right to correct such errors and update information when necessary.
SECTION 17 – PROHIBITED USES
You may use the Services only for lawful purposes.
You may not use the Services to violate applicable laws, infringe intellectual-property rights, distribute malicious software, collect personal information unlawfully, interfere with the operation or security of the website, impersonate another person, or otherwise misuse the Services.
SECTION 18 – DISCLAIMER OF WARRANTIES
To the fullest extent permitted by applicable law, the Services and products are provided subject to the terms and representations expressly stated on the website.
We do not guarantee that access to the Services will always be uninterrupted, timely, secure, or error-free.
Nothing in these Terms excludes warranties, guarantees, or consumer rights that cannot lawfully be excluded.
SECTION 19 – LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, Marissa Lazaridis and our service providers, contractors, affiliates, and representatives will not be liable for indirect, incidental, special, punitive, or consequential damages arising from use of the Services or products purchased through them.
Nothing in these Terms limits liability where such limitation is prohibited by applicable law.
SECTION 20 – FORCE MAJEURE
We are not responsible for delays or failure to perform obligations caused by circumstances outside our reasonable control, including severe weather, natural disasters, illness, supply shortages, carrier disruptions, customs delays, governmental actions, or other similar events.
When reasonably possible, affected customers will be notified of significant delays.
SECTION 21 – TERMINATION
We reserve the right to suspend or terminate access to the Services where these Terms have been materially violated or where otherwise permitted by law.
Provisions concerning intellectual property, payment obligations, liability, and other provisions that by their nature should survive termination will continue to apply.
SECTION 22 – SEVERABILITY
If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision will be enforceable to the fullest extent permitted by law and will be severed to the extent necessary without affecting the validity of the remaining provisions.
SECTION 23 – ENTIRE AGREEMENT
These Terms, together with the policies and other terms referenced on the website, constitute the agreement governing use of the Services.
Failure to enforce any provision of these Terms does not constitute a waiver of that provision.
SECTION 24 – GOVERNING LAW
These Terms and transactions through the Services are governed by applicable law, including the laws applicable in the jurisdiction in which Marissa Lazaridis operates, subject to any mandatory consumer-protection rights that apply based on a customer's jurisdiction.
